Abstract
-
The purpose of this paper is to highlight how the United States Supreme Court is pursuing a new originalist approach in its interpretation of the Religion Clauses, which seeks to implement a “freedom for religion” model. It employs the theoretical perspective put forward by Michael Stokes Paulsen to discuss Kennedy v. Bremerton School District and Mahmoud v. Taylor, which serve as important examples of this paradigm shift. In such a framework, the Establishment Clause and the Free Exercise Clause of the Religion Clauses are treated as complementary clauses, where the latter takes precedence over the former.
